Legal Basement Suite Technical Guide: The Contractor’s Perspective on Saskatoon Compliance

Building a legal basement suite in Saskatoon is a strategic investment that requires a professional bridge between the National Building Code (NBC) and practical design. As your general contractor, we do not just follow the rules; we apply our building expertise to ensure your suite is safe, comfortable, and optimized for its intended use. Whether your goal is a multi-generational family space, a high-revenue Airbnb, or a premium long-term rental, we design the level of finish from entry level to high end to match your specific goals and budget.

Access and Egress: The Foundation of Your Suite

Before we plan a build, we inspect the space for the structural requirements for access. A legal suite must be a self-contained dwelling unit with its own safe exit path.

The Shared Common Landing and Fire Doors

In many Saskatoon "Suite Ready" homes, the most efficient design is a shared side entry and common landing. We treat this common area as a neutral zone that must be technically isolated from both living units.
  • Smoke-Tight Enclosure: The common landing and stairwell must be entirely enclosed in a smoke-tight barrier.
  • Drywall Requirements: This includes installing 12.7 mm (1/2") drywall on the walls and the underside of the stairs.
  • Fire-Rated Doors: Any door leading off this common hallway to the main residence, the suite, or a shared mechanical room must be at least 45 mm (1.75") thick solid core wood or have a 20 minute fire protection rating (FPR).
  • Self-Closing Hardware: All doors in a smoke-tight barrier require a self-closing device to ensure the safety seal is always maintained.
  • Exterior Path: From the suite entrance to public sidewalk, we verify an unobstructed pathway at least 860 mm (34") wide is provided.
  • Interior Landing: A proper interior landing is required at the immediate entrance to the suite.

Bedroom Egress Windows

Every bedroom requires at least one window that can be opened from the inside (without tools) for emergency exit.
  • Opening Size: The unobstructed opening must be at least 0.35 sq m (3.8 sq ft).
  • Minimum Dimension: No dimension (height or width) of the opening can be less than 380 mm (15").
  • Window Wells: Wells must provide at least 760 mm (30") of clear space in front of the window when fully open.
  • Deck Obstructions: If a deck is located over the window, a clear height of at least 760 mm (30") is required to a public thoroughfare.

Structural and Fire Safety: Smoke-Tight Barriers

The smoke-tight barrier is a construction assembly designed to impede the movement of smoke between units.
  • Wall and Ceiling Assemblies: We install a minimum of 12.7 mm (1/2") drywall on each side of walls and on the ceiling.
  • Sealing: All seams must be mudded and taped, and penetrations must be sealed with tight-fitting caulking or approved spray foam.
  • Spray Foam: If spray foam is used, it must be installed by a certified professional and protected by a thermal barrier.

Sound Transmission Class (STC) Ratings

To ensure privacy, Saskatoon requires a minimum STC rating of 43 between the principal dwelling and the suite.
  • Our Build Standard: We achieve this by filling floor and wall cavities with at least 150 mm (5.5") of batt insulation.
  • Decoupling: We utilize resilient metal channels at 400 mm (16") or 600 mm (24") spacing to break sound vibrations.

Mechanical, Heating, and Ventilation Logic

For a suite to be legal, air cannot move from one dwelling unit into the other as it negates the fire separation.
  • Independent Heating: The suite requires its own heating source; common solutions include a dedicated furnace, electric baseboard heaters, or in-floor heat.
  • Independent Ventilation (HRV): Suite ventilation must be separate from the principal dwelling. We typically install a dedicated Heat Recovery Ventilator (HRV) as the principal exhaust and supply air fan.​

Life Safety: Interconnected Alarms

In a professional build, the main house and the suite are linked so that an alarm in one unit notifies everyone in the house.
  • Smoke Alarms: Interconnected alarms are required in each bedroom, on each floor level, and in the common landing area at the top of the stairs.
  • Placement: Smoke alarms must be placed a minimum of 100 mm (4") from a ceiling or wall and a maximum of 300 mm (12") below the ceiling if wall-mounted.
  • Carbon Monoxide (CO) Alarms: Mandatory in each bedroom (or within 5 m of doors) and in common mechanical rooms. (Most smoke alarms do both.) 

Professional Permitting and Coordination

Can my existing furnace heat both the main house and the suite?
No. Air cannot move from one dwelling unit into another as this would negate the smoke-tight wall and ceiling assemblies. A separate heating source, such as a dedicated furnace, electric baseboards, or in-floor heating, is required.
What are the exact dimensions required for a bedroom egress window?
One window in every bedroom must provide an unobstructed opening of at least 0.35 sq m (3.8 sq ft). Additionally, no dimension of that opening can be less than 380 mm (15"). For example, a standard $18"\times18"$ window is only 0.20 sq m (2.25 sq ft) and does not meet the legal requirement.
Do I have to drywall the ceiling of my furnace room?
If the furnace room is considered a common utility room serving both units, the ceiling must be drywalled to maintain the smoke-tight barrier. In cases where the utility room is located within a smoke-tight barrier, such as a stairwell area, all walls and ceilings must be protected.
What is the minimum ceiling height for a legal suite?
The required height for rooms and hallways is 1.95 m (6'5"). This can be reduced to 1.85 m (6'1") specifically under beams and ductwork. The clear height over stairs and landings must also maintain at least 1.95 m (6'5").
Is a separate HRV required for the basement suite?
Yes. The ventilation of the suite must be separate from the principal dwelling unit. HRVs are the most common method used to act as the principal exhaust and supply air fan for the suite.
What are the rules for shared landings and stairwells?
​If a stairwell is used by the suite, the ceiling (underside of the stairs above) must be drywalled and, in many cases, meet a minimum 43 STC rating. All doors leading off a common landing must be fire-rated and equipped with self-closing hardware.
